2017年科学研究概况

        国际法研究所是我国国际法研究领域的学术重镇,同时也是首批国家高端智库之一。国际法研究所依赖于深厚的国际法学研究传统和坚持不懈的创新精神,一系列高水平、高质量的研究成果不断涌现。2017年,国际法研究所在学术研究领域不断创新、努力钻研,研究达到了新的高度。2017年全所研究人员共获得6项奖励殊荣;共出版著作15部,在国内外学界和实务界产生了较大反响;还在Chinese Journal of International Law、Hong Kong Law Journal、人民日报、中国法学等国内外知名期刊和报纸上发表各类学术论文60余篇,提交咨询报告50余篇。此外,2017年国际法研究所还承担了横向、纵向各类科研项目近30项;部分教师还获得了各级各类的表彰多项,其中何其生教授入选第八届“全国十大杰出青年法学家”。

 

        2017年主要学术成果简介

        (一)肖永平、冯洁菡:《中国促进国际法治报告(2016年)》(中英版),社会科学文献出版社2017年11月1日出版

        本书旨在系统梳理近年来国际法治的新发展,着重阐述中国在国际法治的各个重要领域所表明的理念、坚持的原则和立场,以及采取的具体行动,系统展示了中国对促进国际法治做出的重要贡献。全书由中国与国家间关系法治、中国与国际经济关系法治、中国与国际民商事法治、中国国际法的教学和传播四部分组成。

        本书注重实用,系统梳理了中国改革开放30余年来践行国际法治的成就与挑战,可以作为已经发布的《中国法治建设白皮书》的补充。它作为中国民间智库的研究成果,可为国家机关和政府部门及其领导人提供全面、系统、与时俱进的国际法治信息,为治国理政提供参考;便利于各级地方政府和企业开展对外贸易、投资、金融合作以及其他民商事交往与合作。本书阐述的是中国特色的国际法治实践。它在一定程度上克服了我国国际法研究长期以来理论脱离实际的弊端,为我国的国际法教学与研究提供了系统的国家和政府实践的信息资料,并且开辟了新的研究路径,从而有利于促进我国的国际法学在全球范围内逐步形成中国风格和中国气派,提升中国在国际法治进程中的话语权和影响力。

        (二)黄志雄:《网络行动国际法塔林手册2.0版》(中英文版),社会科学文献出版社2017年11月1日出版

        本书是试图通过学者的集体研究来推动网络空间国际规则制定的大型手册。该手册第一次较为系统、全面地涉及了主权、管辖权、国家责任、人权法、海洋法、国际电信法等15个领域的和平时期网络空间国际法规则,同时也修订和涵盖了2013年《塔林手册》所针对的网络战国际法规则,从而构建了一个包含和平时期和战争时期、相对完整的网络空间国际法规则体系,受到了广泛的关注。

        (三)杨泽伟:《国际法析论》(第四版),中国人民大学出版社2017年10月1日出版

        本书结合当代国际关系的有关实践,以历史与现实社会为背景,探讨国际法的一些基本理论问题与国际法若干新发展,重点分析国际法上的国家主权,论述国际法的历史发展,阐释海洋法发展的新动向,剖析国际组织与国际法的系列问题,研究国际能源法律和政策及其对中国的借鉴与启示,阐明中国与国际法问题。通过研究,得出了若干规律性的认识。全书视野开阔,重点突出,资料丰富,论证严密,既注意借鉴和吸收国内外目前的研究成果,又力图跟踪和反映国际法学的最新动态。

        (四)杨泽伟:《United Nations Convention on the Law of the Non-Navigational Uses of International Watercourses: Problems, Improvements and Potential Influence on China》,《Hong Kong Law Journal》 2017年第1期

        Abstract: United Nations Convention on the Law of the Non-Navigational Uses of International Watercourses is the only international treaty that governs the uses and conservation of the waters that cross international boundaries. However, its major defects in territorial sovereignty and dispute settlement mechanism should not be ignored. International society should improve the Convention with amendments, interpretations and should play a bigger role of international organisation. China, although yet to ratify the Convention, will still be influenced potentially by the rule-making treaty on its uses and conservation of relevant waters. Given the advantages and feasibility of its accession to the Convention, China should make serious consideration to ratify the Convention for its national interests.

        (五)何其生:《Chinese Practice in Private International Law in 2016》,《Chinese Journal of International Law》2017年第4期

        Abstract: This paper is composed of materials reflecting the practice of private international law in China in 2016. First, this paper covers the report of the Supreme People's Court (SPC) released in 2017, notably the Report on the Work of the SPC in 2016, which contains the statistics of the foreign- related civil or commercial cases accepted and concluded by Chinese courts. Second, the paper covers judicial interpretations that took effect in 2016. The important legal instruments that have been translated include: the Provisions of the SPC on Several Issues concerning the Trials of Independent Guarantee Cases and the Provisions of the SPC on Several Issues concerning the Adjudication of Cases Occurring in the Sea Waters under China's Jurisdiction (I). Third, this paper focuses on typical cases decided by various Chinese courts during 2016 that dealt with the following issues: agent ad litem; jurisdiction (involving representative office and forum non conveniens); choice of law (classification of legal relationship, gambling debt, loan contract); proof of foreign law; recognition and enforcement of a Singapore judgment; validity of the dispute resolution clause containing both litigation and arbitration; recognition and enforcement of foreign arbitral awards (involving the review at the request of the party or ex officio review by the court, procedure review, qualification of arbitrator, division of arbitration costs, excess of authority and division of an arbitral award, and public policy).

        (六)黄志雄:《Towards the International Rule of Law in Cyberspace: Contrasting Chinese and Western Approaches》,《Chinese Journal of International Law》2017年第2期

        Abstract: China and Western countries have repeatedly portrayed each other as potential or actual adversaries in cyberspace. Yet, both sides proclaim that they subscribe to an international consensus that cyber operations must be subjected to the rule of law. Against this background, the article examines five key aspects of the rule of law in cyberspace, which are ordinarily understood as areas of contention: (1) preferred method of identification and development of international law; (2) competing models of cyberspace governance; (3) application of sovereignty to cyberspace; (4) question of militarization of cyberspace; and (5) legality of cyber espionage. Our analysis demonstrates that it is inaccurate to view China and the West as sharply divided and competing camps. Rather, the emerging picture reveals a web of relationships and views that reflect an overall trajectory of convergence, even if modest in scope and velocity.

        (七)崔晓静:《中国与“一带一路”国家税收协定优惠安排与适用争议研究》,《中国法学》2017年第2期,《新华文摘》2017年第13期转载,《人大复印资料》2017年第8期转载

        摘要:“走出去”企业在“一带一路”国家投资过程中可能面临企业的同一笔所得被重复征税、未能在东道国享受本应该享受的税收待遇或税收优惠,存在受到税收歧视或者不公平待遇等多种税收风险,以及在投资过程中与当地税务机关发生的税务争议如何解决等问题。企业在“一带一路”沿线国家进行投资时,要注意了解投资东道国与我国签订的税收协定的内容,主动利用利息、股息、特许权使用费等协定优惠安排,降低企业涉税风险和成本。在与投资东道国发生税务争议时,要注意向我国税务主管当局申请启动相互协商程序寻求救济,以维护自身的合法权益。
