中文版《外国判决在亚洲的承认与执行》出版

        本所郭玉军教授主持翻译的《外国判决在亚洲的承认与执行》一书于2020年5月由法律出版社出版。该书是武汉大学国际法研究所国际法文库系列丛书的首部译著。中文版翻译人员有(按翻译分工顺序):邹国勇(武汉大学国际法研究所副教授、法学博士)、张文亮(中国人民大学法学院副教授、法学博士)、马明飞(大连海事大学法学院教授、法学博士)、郭玉军(武汉大学国际法研究所教授、法学博士)、李洁(山东大学法学院讲师、法学博士)、梁雯雯(武汉大学国际法研究所副教授、法学博士)、向在胜(中南财经政法大学法学院教授、法学博士)、朱磊(武汉大学国际法研究所副研究员、法学博士)、霍政欣(中国政法大学国际法学院教授、法学博士)、甘勇(武汉大学国际法研究所副教授、法学博士)。

        国际法文库总主编为黄进教授、执行主编为肖永平教授。该书英文版是新加坡亚洲商法研究所“法律趋同系列丛书”之一,项目主持人和编辑是新加坡管理大学张瑞苓副教授。

        该书包括东南亚国家联盟(东盟)十个成员国(文莱、柬埔寨、印度尼西亚、老挝、马来西亚、缅甸、菲律宾、新加坡、泰国、越南)和亚洲其他五个重要经济体(中国、印度、日本、韩国和澳大利亚),共计15个国家有关外国判决承认与执行的国别报告。报告人均是其各自所在法域有关外国法院判决承认与执行领域的知名法学专家和实务专家,驾轻就熟地较为系统地阐述了各自所在法域有关外国判决承认与执行的规则。这是首次发布的涉及东盟所有成员国及其主要贸易伙伴的国别报告,无论是对学术界还是实务界均具有重要参考价值。

        每篇国别报告都简洁明了,通俗易懂,但又包含足够丰富的信息,可以使读者快速有效地获悉外国判决在特定的法域内得以承认与执行的条件与程序。这部著作的特点不仅在于其涉及国家的广泛性,更在于其具有真实表达每个法域的多样性特征的丰富性。报告内容涉及有关法域参加或缔结的条约、相关国内法规定、法院案例等。

        亚洲国家分别属于普通法系、大陆法系和混合法系,对15个国家的有关规则与实践的阐述,对了解不同国家法律之间重大或细微的差异,具有重要参考意义。

 

 

        The Chinese Version of Recognition and Enforcement of Foreign Judgments in Asia Published

 

        The compendium “Recognition and Enforcement of Foreign Judgments in Asia” in Chinese was published by Law Press in May 2020. The Chinese version was sponsored by Professor Guo Yujun, Wuhan University, China. The book is the first translation work of the series of international law sponsored by the Institute of International Law, Wuhan University, China. The contributors of the Chinese version are Dr Zou Guoyong Associate Professor, School of law, Wuhan University, Dr Zhang Wenliang Associate Professor, Renmin University of China Law School, Dr Ma Mingfei Professor, Dalian Maritime University Law School, Dr Li Jie Lecturer, Shandong University Law School, Dr Guo Yujun Professor, Wuhan University Institute of International Law, Dr Liang Wenwen Associate Professor, Wuhan University Institute of International Law, Dr Xiang Zaisheng Professor, Zhongnan University of Economics and Law Law School, Dr Zhu Lei Associate Researcher, Wuhan University Institute of International Law, Dr Huo Zhengxin Professor, China University of Political Science and Law School of International Law, Dr Gan Yong Associate Professor, Wuhan University Institute of International Law.

        The chief editor of the series is Professor Huang Jin and the executive editor is Professor Xiao Yongping. The English version of the compendium is one of the series of“Legal Convergence Series” of the Asian Business Law Institute in Singapore. The project moderator and editor are Associate Professor Adeline Chong, Singapore Management University.

        The compendium includes the country reports of the ten members of the Association of Southeast Asian Nations (ASEAN, Brunei, Cambodia, Indonesia, Laos, Malaysia, Myanmar, Philippines, Singapore, Thailand, Vietnam) and other five important Asian economies (China, India, Japan, South Korea and Australia), a total of fifteen countries’ rules and practice about recognition and enforcement of foreign judgments. The reporters are all well-known legal academics and practitioners in the field of recognition and enforcement of foreign judgments in their respective jurisdictions, and the rules governing the recognition and enforcement of foreign judgments in their respective jurisdictions are elaborated systematically. It was the first country reports to be issued, covering all ASEAN member States and their major trading partners, and have important reference value for both academics and practitioners.

        Each country report is simple and easy to understand, but contains sufficient information to enable readers to learn quickly and effectively about the conditions and procedures under which foreign judgments are recognized and enforced in a particular jurisdiction. This work is characterized not only by its extensive coverage of States, but also by its richness in expressing the diversity of each jurisdiction. The report covered treaties to which the relevant jurisdictions were parties or concluded, relevant domestic law provisions and judicial practice.

        Asian countries belong to the common law system, the civil law system and the mixed legal system. The elaboration of the relevant rules and practices of fifteen countries is of great importance to understand the significant or subtle differences between the laws of different countries.
