From May 20-23, 2014, Professor HE Qisheng of our institution was invited by the Ministry of Foreign Affairs to participate in the negotiations of the CONVENTION ON THE SERVICE ABROAD OF JUDICIAL DOCUMENTS IN CIVIL and CONVENTION ON THE TAKING OF EVIDENCE ABROAD IN CIVIL OR COMMERCIAL MATTERS. The Special Committee is held every six years and the working languages are English and French.
The EVIDENCE CONVENTION currently has 58 Contracting States. The main topics covered in this discussion include: the guidebook of the model form of the request, the advance payment of the evidence collection and electronic transfer. After discussion, Taking of Evidence by Video-Link will be discussed by a special expert group or working group later.
The CONVENTION ON INTERNATIONAL ACCESS TO JUSTICE is also an important topic of this conference. The Convention currently has 26 contracting parties. China has not yet acceded to the Convention, but it is worthy for China to have in-depth study on it.
The Hague Convention on Servings currently has 68 States parties. The main topics of the discussion were: assistance in determining the address of the person to be served, guidelines for the use of the request form, informal delivery, and electronic delivery. The intersection of the Hague Convention on Delivery and the EVIDENCE CONVENTION is also a main topic at this meeting.
The Chinese delegation is led by the Ministry of Foreign Affairs and its members are from the Ministry of Foreign Affairs, the Ministry of Justice, the Supreme People's Court, the Department of Justice of the Hong Kong Special Administrative Region, the Hong Kong High Court, the Law Reform and International Law Affairs Bureau of the Macao Special Administrative Region and Wuhan University. Taking into account the special and technical nature of the discussions of the UNSCOM, the Chinese delegation specially convened a coordination meeting of the Mainland China, Hong Kong and Macao before the meeting to determine the main issues and positions of concern. During the discussion in the conference, the delegation made a profound exposition on the issues of concern, demonstrated its position, and actively coordinated with the parties to achieve acceptable results, which was endorsed by the UNSCOM and chaired by the meeting. The Special Committee expressed its gratitude to China for its conclusions and recommendations.
