At 9:00 on February 24, 2011, Dr. Allan Rocha de Souza, a well-known intellectual property scholar and professor of the Federal University of Rio de Janeiro, Brazil, gave a lecture on "Brazil Copyright Law Reform" for all teachers and students of the Institute of International Law of Wuhan University at 323, Institute of International Law of School of Law. The lecture of was moderated by Professor Nie Jianqiang, Professor of Wuhan University Law School and Deputy Director of the Institute of International Law.
First of all, Professor Nie Jianqiang introduced Dr. Allan Rocha de Souza to everyone. Dr. Allan Rocha de Souza is a professor of intellectual property at the Federal University of Rio de Janeiro, Brazil. His important academic direction is the study of civic cultural rights and is one of a small number of international scholars to study Brazilian copyright law.
Professor Allan Rocha de Souza comprehensively analyzed and elaborated on the status quo, major obstacles and future development direction of Brazilian copyright law reform from the perspectives of history, economy, society and law. The content of the lecture mainly includes the following aspects: First, the legislative history of Brazil as a whole and the legislative history and current status of copyright. Since the current Brazilian copyright law only ignores the social and economic conditions based on the consideration of the Brazilian government, the current situation Copyright law is in fact a illusory; second, the main drivers of Brazilian copyright law reform include not only external factors such as the development of international treaties such as the Berne Convention, the Agreement on Trade-Related Aspects of Intellectual Property Rights, but also international recognition. Third, the main obstacles to the reform of Brazilian copyright law. For example, the legal obstacle is the obstacle of the Brazilian Constitution; the political obstacle, that is, the Brazilian government once focused its work on the Brazilian economic crisis and could not take into account the reform of copyright law; Fourth, the status quo and development direction of Brazilian copyright law reform. Since Brazil's current copyright law has had a serious impact on the economic development of the whole society, the issue of copyright law reform has become one of the heated topics with intense participation in the discussion throughout Brazil, which also brings games and competition between stakeholders in copyright law. The reform of the Brazilian copyright law is still in the heated discussion, the Brazilian government is trying to guide the reform of copyright law by paying attention to the "cultural right".
