On April 22, the 10th Wuhan University International Law Forum 2018 was successfully held in Room 323 of Law School. The speaker was Ma Xinmin, Vice Director-General of Department of Treaty and Law in the Ministry of Foreign Affairs. He gave a speech with the theme of A Basic Structure of a Future Multilateral Investment Court while the host is Prof. Huang Zhixiong.
In this lecture, the main content is divided into three parts to comprehensively introduce the new trends in the development of international law, new topics in international law legislation, and new practices in the application of international law. Among them, in the first part: the current changes in international relations and the developments and characteristics of international law, Ma has focused on the background of the development of international law, the developments and characteristics of international law, including values and interests, participants and international legislation. The issue of diversification, as well as the analysis of the key changes in international legislation, the interpretation and application of international law, and the strengthening of the enforcement of international law, Ma combined with his own experience in international negotiations and international positions, theory and practice, the current The development of international law is discussed.
In the second part, he talked about the new issues in the field of international law, Mr. Ma has explained the hot issues in the current eight major fields, so that teachers and students can understand the most cutting-edge issues in international law research. In the aspect of marine legislation, the issues of negotiations on international agreements on biodiversity in areas beyond national jurisdiction (BBNJ) and negotiations on regulations for the development of mineral resources in international seabed areas were discussed in depth; in the issue of outer space governance, the commemoration of the 50th anniversary of the Conference on Outer Space was discussed. The legal issues of space traffic management and the issues of international law applicable to small satellite activities, etc., explain the exploration and development of space resources and the long-term sustainability guidelines for extraterrestrial activities. In the global governance of networks, the current law is mentioned. The application of the law and the development of the cyberspace international law platform, and how to accelerate the promotion of cyberspace legislation; in the Antarctic law and Arctic law issues, mainly elaborated the legal framework, management mechanism and the existing Problems and challenges, and how we should deal with it as a maritime power; in the climate change and environmental governance issues, we mainly analyze and explain the negotiation of the Paris Agreement and the World Environment Convention advocated by France, proposed for international climate and environmental governance The sixth and seventh issues are the International Governance of Refugee and Immigrant Protection and International Humanitarian Law; the last issue is a new process of international law codification that sets out the series of events and issues convened by the International Law Commission to celebrate its 70th anniversary; : In the new practice of application and enforcement of international law, Ma has analyzed and elaborated the application and implementation of international law from five aspects, revealing the problems and challenges faced by international law in its application and implementation; I talked about several international law issues in current diplomatic practice, and ended this lecture by analyzing several important international law practices and domestic legislation and issues related to international law.
Mr. Ma’s speech was high-rise, the case was detailed, the theory was combined with the reality, and the teachers and students listened and listened carefully and took notes carefully. There was no rest during the whole journey, but Ma’s director and teachers and students were not sleepy and tired. At the end of the lecture, Professor Huang Zhixiong summed up the lecture, and outlined the mission of Ma’s new features, new issues and new developments in the development of international law, and the mission of Ma’s international law as a position to safeguard national interests. The sense expressed sincere admiration and believed that the Ma Shichang report has important practical guiding significance for the teaching of international law, scientific research and the construction of high-end think tanks. Ma Xinmin, currently deputy director of the Department of Law and Law of the Ministry of Foreign Affairs, has worked in the Department of Foreign Affairs and Law, the Chinese representative office of the Sino-British Liaison Group, the Office of the Ministry of Foreign Affairs in Hong Kong, the Xinhua News Agency Hong Kong Branch, the Central Government Liaison Office in Hong Kong, and the Embassy in the United States. Multilateral and bilateral international conferences and negotiations, including the Internet, the Arctic and the Arctic, tobacco control, mutual legal assistance and extradition. He has served as a member of the Bureau of the United Nations Committee for the Peaceful Uses of Outer Space and the Bureau of the Pre-Committee of the International Agreement on the Conservation and Sustainable Use of Marine Biodiversity (BBNJ). He is currently the vice president of the Asian Society of International Law, the vice chairman of the 23rd session of the International Seabed Authority, the member of the Steering Committee of the 50th Anniversary of the United Nations Conference on the Exploration and Peaceful Uses of Outer Space, the Legal Adviser of the International Bamboo and Rattan Organization, and the Vice President of the Chinese Society of the Law of the Sea. He has published dozens of papers in the "China International Law Journal", "China International Law Journal", "Asian International Law Journal" and other publications.
