On September 1, 2016, the lecture’s theme was the HCCH: the 2005 Hague Choice of Court Convention , and the ongoing negotiations of the future Hague Judgments Convention. The lecture was hosted by Guo Yujun, vice president and secretary general of the China Institute of Private International Law and professor of the Institute of International Law of Wuhan University. Professor Guo introduced the main academic achievements and work focus of Secretary General Christophe Bernasconi. Secretary-General Christophe Bernasconi thanked the International Law Institute of Wuhan University for his kind invitation and expressed sincere gratitude to the teachers and students who participated in the lecture!
The content of the lecture begun with the introduction of the history and current situation of the Hague Conference on Private International Law. The Hague Conference on Private International Law, as an international organization, has always been committed to promoting the coordination and unification of the rules of private international law. The legislative function of the Hague Conference on Private International Law is from treaty and practice. The aspect has been introduced in detail.
The Hague Conference on Private International Law currently has 38 major treaties and agreements aimed at resolving conflicts of law including international civil litigation and legal cooperation, marriage and family law, business and financial law. From 1995 to 2016, the number of members is increasing. There are currently 81 members in 80 countries and one economy (EU), and 148 countries (regions) are members of the Hague Conference on Private International Law. Secretary-General Christophe Bernasconi then introduced the two main tasks of the Hague Conference on Private International Law and gave a detailed introduction to the content of the China and Hague Private International Law Conference, including the participating treaties and practices.
At the same time, Secretary-General Christophe Bernasconi introduced the scope and core of the 2005 Hague Convention on the Choice of Court Agreements and the core obligations set out in Articles 5, 6 and 8 of the Convention. The Secretary-General also simulated a case for the lecture to better introduce the practical operation and application of the Convention. In addition, he also elaborated on the ongoing project of “recognizing and implementing foreign court judgments” at the Hague Conference on Private International Law, introducing the controversial issues and looking forward to the future of the future convention.
Secretary-General Christophe Bernasconi had a positive interactive question and answer session with the teachers and students during the lecture and after the lecture.
