Lecture 10: Professional issues in international law and international exchanges

On November 15, 2009, Professor Yi Xianhe, the chief expert of the Institute of International Law of Wuhan University, gave a lecture entitled "Professional Issues in International Law and International Communication" for the participants of the "Advanced Training Course for Young Laws of Young Teachers in Colleges and Universities of the Ministry of Education".
In the opening remarks, Professor Yi drew attention to the professional issues in international law and state relations by enumerating a series of contradictions and problems. Professor Yi pointed out that China has made great achievements in the economic field. Correspondingly, in the field of international law, it has not achieved simultaneous results. It was worthy of everyone's vigilance and encouraged everyone to forge ahead. Professor Yi Xianhe's report was divided into two parts. In the first part of the report, Prof. Yi gave a detailed analysis of the concepts, attributes and considerations of “professional issues”. Prof. Yi cited the definition of “professionality” in the foreign-language English dictionary for everyone, and on this basis, analyzed the extension and connotation of “professionality” from two aspects: general attributes and special attributes. According to Prof. Yi’s analysis, the professionalism in the general sense mainly refered to the attitude of “exhibiting a courteous, conscientious, and generally businesslike manner” in the workplace or in dealing with people (literally translated as courtesy, careful and responsible, effectiveness). Professionalism in a special sense means that there is a special "characterized by or conforming to the technical and/or ethical standards as well as the spirit of a profession; ethical behavior; and self-motivation." In the industry, practitioners have a high professionalism, good morality and self-motivation and promotion mechanisms.
In international exchanges, such professional issues need to be taken seriously in every public place. As a lawyer of a professional, it is necessary to strictly abide by these than the average lawyer, not only to solve the problems, but also to further consider the policy issues reflected behind the problems. Next, Professor Yi explained the connotation of professional issues in three levels.
1. Point of reference. Pay attention to the reference point of the problem and pay attention to the analysis of the problem from different angles.
2, Framework rules or methods. The framed content and methods are determined after the reference point.
3. Challenging. Based on the former two, you can add your own thinking, analyze and even criticize existing ideas, and be leaders in the field of thought. Reflected in international exchanges, in international exchanges, we must understand the respect of each other's ideas and facilitate communication between the two sides. Keep the right distance between people and leave room. In the interaction, involving the other party's personal information and even privacy, do it as soon as possible, not too deep, so as not to misunderstand and unpleasant. Maintain a standardized format throughout the communication. On the personal side, focus on personal hygiene and clothing, taking into account sensitive matters. Professor Yi pointed out in particular that in foreign-related exchanges, it is appropriate to make some preparations for the response, and to pay attention to confidentiality. Professional issues should be handled by professional diplomats.
In the academic research of international law, Professor Yi pointed out the basic knowledge of international law such as the UN Charter and Article 38 of the International Court of Justice. To use common format specifications, such as the Chicago format manual, the US "The Bluebook", OSCOLA, and recommend the Chinese JIL annotation specification. Professor Yi pointed out that there are many places worthy of challenges in the field of international law. International law provides a lot of opportunities for innovation and hopes that everyone can make more innovations.
In the second part of the report, Prof. Yi Xianhe combined his own personal experience to analyze how to submit articles to Chinese JIL and other SSCI publications. Professor Yi advocated that he should start his own papers in three aspects, namely new idea and argument, analysis, new materials, that was, new ideas, good analysis, new materials, and suggest that you use the legal professional database and famous libraries. The data retrieval function was effective in making the topic novel and the argument was perfect. In the empirical stage, Prof. Yi used his own paper published in the Colombian legal review as an example to analyze the whole process of selecting, constructing, completing and publishing the paper, which was very enlightening to everyone. In the interactive session, Professor Yi enthusiastically answered the questions from the participants.
