Professor Zuker, Justice of Ontario, Canada visited the Institute.

At 9:00 am - 11:00 am on April 22nd, Professor Justice Marvin A. Zuker of the Ontario High Court of Justice and the University of Toronto Institute of Education gave a wonderful lecture on Canadian family law in the 323 classroom of the School of Law. The report was hosted by Professor Guo Yujun, Director of the Department of Private International Law, and undergraduate, master and doctoral students from the Institute of International Law listened to the report.

 

Professor Zuker first introduced Canada's legal system and court system, pointing out that the Canadian legal system includes federal law and provincial law, while Canadian courts are divided into two systems, the federal court and the provincial court. The Federal Court of Canada is the judicial body of the Commonwealth of Canada, and the Federal Supreme Court is the highest judicial body in Canada, accepting appeals against all provincial and district court decisions. Each province in Canada has a three-tier court system, namely the provincial court, the provincial high court and the appeal court. Professor Zuker then focused on Canadian civil, criminal and family law on the scope of cases accepted by the Canadian Provincial Court System (civil, criminal and family). First, he introduced the trial of civil cases. The civil disputes with a small target amount (below 25,000 Canadian dollars) were mostly tried by the provincial courts, and the parties did not need to ask for a lawyer; if they exceeded 25,000 Canadian dollars, they were accepted by the provincial high court and the parties Can ask a lawyer. The high legal fees make the parties overwhelmed, but the Canadian legal aid system provides legal services to the parties free of charge. In addition, the Canadian statute of law plays a very important decisive role in the civil proceedings and the exercise of the parties’ right to appeal; in 1982, the Canadian Constitution and the Charter of Rights and Freedoms made all the laws that contradicted them have to be amended, leading to the legalization of homosexual marriage. Secondly, the professor introduced Canada's criminal law, pointing out that the criminal responsibility age specified in the criminal law is bounded by 12 years old, and children under 12 years old are not criminal subjects; the professor also gave examples of the protection of children's privacy rights. Finally, the professor focused on the Canadian Family Law and focused on the protection of children's rights, and discussed the custody, visitation and support of children in specific cases. Professor Zuker used his many years of trial experience to clarify the influence of his father's income status and conduct on children's growth, and thus used it as an important factor in the judgment and maintenance.

 

During the lecture, Prof. Zuker provided ample opportunity for students to take the opportunity to ask questions. The students used fluent English to ask professors about family issues, foreign marriages, surrogacy and other hot issues. The professor answered them patiently.

 

Finally, Professor Guo Yujun commented on Professor Zuker's report. The report is rich in content and very exciting. The professor gave a clear introduction to Canada's legal system and court system. Especially the introduction of Canadian family law was very interesting, of which cases made us very inspired.
