Speech by Professor Huang Jin at the Closing Ceremony of the 2003 Annual Meeting of the China Society for International Private Law (Huangshan)
Dear Mr. Han, precedents, teachers, and classmates:
After two days of intense and orderly work, the China Society for International Private Law’s 2003 annual meeting is about to close. During these two days of meetings, we seriously discussed the draft of the International Private Law part of the Civil Code,, and discussed the issues of international commercial arbitration and international civil litigation. They also held the Council, the Standing Council, the President and the Vice President. The agenda has been completed. There are more than 150 people attending this annual meeting. There are both old friends and new friends. There are representatives from the Hong Kong Special Administrative Region and compatriots from Taiwan on the island of the motherland. Some old friends who have not seen for many years have also come to the meeting. There are also representatives coming on the way today and tomorrow.. This fully demonstrates that everyone is very enthusiastic about the work of the Society and attaches great importance to the work of changing the course. It can be said that this year's annual meeting is another grand event following the Shanghai annual meeting last year. It is a united meeting, a successful meeting, and a satisfactory meeting!
At this annual meeting, the Society has carried out the change of the Council, the Standing Council, the President and the Vice President. Mr.Han and other older scholars, experts and professors, the teachers of our young and middle-aged scholars, left, they left the first line of learning to work and the Society successfully achieved the succession from new to old. What I want to emphasize is that leaving the first line of their work does not mean staying away from us. They are still the honorary presidents or consultants we have learned. More importantly, they are always our teachers and our mentor. ! At this moment, I think everyone’s mood is the same as that of me. There are many, many words to say about these old people who have led us into international private law, studying international private law, inheriting international private law, and innovating international private law. There are many, many words to talk about. A thousand words summaried to a sentence is: heartfelt thanks and good wishes. First of all, we would like to thank Professor Han Depei, the founding president of our Society, and our beloved Mr.Han. The Society was founded in 1987. In the past 18 years, Mr. Han created the development process of the Society from scratch, from small to large, from weak to strong. Today, our Society is now the one of the most active international private law academic groups all over the world, China's international private law graduate education has ranked first in the world in terms of scale. It is no exaggeration to say that without the foresight of Mr.Han, without the broad mind of Mr.Han, without the planning and operation of Mr.Han, there is no such thing as we have learned today. I propose that we would like to thank Mr.Han for his outstanding contribution to the Society with warm applause! I sincerely hope that his elderly will live long and healthy! Secondly, we would like to thank the other scholars, experts and professors who have learned the older generation, including Mr. Fei Zong, Li Shuangyuan, Yao Zhuang, Zhu Xueshan, Liu Zhenjiang, Qian Ye, Zhang Zhongbo, Liu Huishan, Zhang Shangjin, etc. . They love to learn, care about learning, and love the Society, and have made outstanding contributions to the work and development of the Society. I propose, let us express our heartfelt thanks to them with warm applause! I sincerely hope that they will live long and healthy! At the same time, we would like to sincerely thank the NPC Law Committee, the Supreme People's Court, the Department of Treaty and Law of Minitry of Foreign Affairs, the Department of Treaty and Law of Ministry of Commerce , CIETAC for their support of the work of the Institute. Their support has enabled us to learn more closely with the practice of international private law. . The above is what I said on behalf of the Society. Below, I personally want to say a few words of thanks. Since 1985, Professor Han Depei and Professor Li Shuangyuan have organized the first national conference on international private law and served as the secretary of the preparatory group of the China International Private Law Research Association. Later, when the China International Private Law Research Association was established in 1987, he served as the secretary general of the research conference. It was carried out under the leadership, guidance and care of the older generation of international private law scholars, experts and professors such as Mr. Han. Over the years, everyone has given great support to my work. This time, I am very honored to have been loved by all of you. After democratic consultations, I was elected president of the Society. Here, I would like to express my heartfelt thanks to everyone for their trust! I strive to live up to my mission and do what I should learn.
Regarding the work of the Institute, I would like to talk about two points: First, to strengthen the unity. According to the charter of the Society, the Society should unite the people who are engaged in the teaching, scientific research and practical work of international private law, and promote the academic development and legal system construction of China's international private law. It can be seen that the unity and cohesion of the colleagues of the national international private law community and various international private law forces is an important work of the Society. Strengthening the unity of the Society is not only the purpose of the Society, but also the prerequisite and necessary condition for learning to carry out all work and further development. If one society can't unite and has no cohesiveness, it can't do anything, everything else is just empty talk. Since 1985, under the inspiration and leadership of the banner of Mr.Han, the Society has always been full of talents. It has united the national international private law colleagues, including Hong Kong, Macao and Taiwan colleagues, to carry out all the work of the Society. Unity has become a glorious tradition of our learning. I remember that when the first national conference on international private law was held in Huaxi, Guiyang in 1985, everyone expressed their views on the object and scope of adjustment of international private law. The debate was red-faced. I was the secretary of the meeting. I was worried about scholars when I saw this situation of the unity between them, but in fact everyone's friendship has not been affected. I felt the academic spirit of our international private law scholarship at that time, that is, seeking common ground while reserving differences, and being different. Today we renew our emphasis on strengthening unity and are of great significance to the sustainable development of the Institute. To strengthen unity, we must first learn to respect, because respect is the foundation of unity. The report of the 16th National Congress of the Communist Party of China has a particularly good statement. It is to implement the principle of respecting labor, respecting knowledge, respecting talents, and respecting creation in the whole Society, and forming a social trend of respecting labor, respecting knowledge, respecting talents, and respecting creation. And these four respects are based on the premise of respecting others. We hope that the young and middle-aged scholars we learn must respect old scholars, old experts, old professors, and precursors, learn from them humbly, and learn their maturity, stability, and experience. Senior scholars should be open-minded and carry forward. Peer scholars should respect each other and treat each other as equals. They should not seek common ground, but seek for their own, coexistence and common prosperity. To strengthen unity, we should also unite all those who can unite and enthusiasm for the activities of the Institute of international private law. We welcome them to join us and become members of our family of international private law. In this change, we have proposed the qualifications for a member of the board of directors, that is, we must be enthusiastic about the activities of the Institute of international private law. For those who are not enthusiastic about learning activities, there is no need to bother them. In the future, we ask the directors of the Society to participate in the activities of the Society as much as possible. There is no special reason. If we don’t participate in the year, we will understand it. If you don’t participate in two years, we can understand it. If you don’t participate in three years, it is a little bit utilitarianism especially when you only attend the four-year-change -meeting. Of course, the Society still welcomes them. In short, we must unite all colleagues in the international private law community who are enthusiastic about the activities of the Institute of international private law. The second point about learning to work is to continue to develop and plan for development. Comrade Deng Xiaoping said that development is the last word. Although this is for the national economic construction, I think it is applicable to the work we have learned. Only by continuous development can the Society flourish and learn that only sustainable development can have a long-lasting vitality.
Therefore, in the future, it is necessary to promote the development of China's international private law academic development, the development of private international legal system, and the development of international private law professionals. With regard to how to plan for the further development of the work of the Institute, I have three ideas and put forward for your reference: 1. The road to enriching the connotation of development is to develop the road of enrichment and connotation on the basis of learning the existing work. First of all, we have to run an annual meeting, which is the most important carrier of the activities of the society and a platform for our academic exchanges. In the future, we must make the annual meeting more effective, more targeted, and more colorful. Secondly, further complete the "China International Private Law and Comparative Law Annual Report". At present, the key to running an annual magazine is to further improve quality, improve academic standards, and expand the influence of academic circles at home and abroad. We must gradually turn the annual publication into bilingual publications in both Chinese and English. At the same time, further expansion of the participation of colleagues in international private law is one of the measures to further improve its quality and level. Thirdly, in response to the revision of the International Private Law Part of the Civil Code and the revision of the Arbitration Law, the practice of foreign-related judicial trials has formed a number of special research groups to further study and propose research reports and revision of advisory opinions. At the same time, the organization drafted the Model Law of the Arbitration Law. Fourthly, from time to time, small-scale seminars and small regional seminars will be organized to make the academic activities of the Institute of international private law more diverse. Fifthly, 2005 is the 20th anniversary of the nationwide international private law academic activities. 2007 is the 20th anniversary of the establishment of the China Society of international private law. We propose to commemorate the 20th anniversary of the establishment of the China Society for international private law and convene an international conference on international private law with the theme of ‘Reviewing History, Promoting Academics, Promoting the Rule of Law, and Looking to the Future’, including a series of old photographs. Sixthly, strengthen communication with the substantive departments of international private law to further promote the connection between theory and practice. 2. Taking the road of international development, Mr.Han summarized the work since the establishment of the annual meeting at the opening ceremony of the annual meeting. He pointed out that there are three shortcomings in the work of the Society: First, insufficient international academic exchanges; secondly, insufficient theoretical connection, and thirdly, no influential theory and doctrine at the international level. Two of them indicate that China Society for International Private Law is not internationalized. Therefore, taking the road of international development has become our inevitable choice. At present, there are many reasons for the low degree of internationalization of the society. There are external reasons as well as our own reasons. To change this situation, it is necessary to strengthen contacts and exchanges with foreign counterparts. It is necessary to actively participate in international academic conferences and other activities. You need to come in and go out. More importantly, you should write professional articles on international private law in English and published in the mainstream law journal. 3. Taking the road of modern development, first of all, it is to identify the orientation of the Institute, to clarify the functions of the Institute, to gradually establish a modern society system and operational mechanism in the management of the society, and to affirm the good institutions and mechanisms by modifying the constitution of the Society. In this way, we can always maintain the vitality and sustainable development of the Society. Secondly, it is of great importance to use modern information technology to carry out the work of the Society. The main task is to run the website of the China Society for international private law, making it an important platform for the distribution of information resources and the exchange of information among members of the Chinese international private law community. At the same time, it is necessary to strengthen and realize communication and communication between members and members through the Internet.
In short, we have the determination, confidence, and perseverance to carry out the work of the Society. We believe that as long as we all work together to strengthen unity and actively plan the development of the Institute, the China Society for International Private Law will definitely be even better tomorrow!
