Becoming an adult? Becoming a mature person? Becoming an useful person? - Speech delivered by Dean Xiao Yongping at the Opening Ceremony of the 2010 Freshmen of Wuhan University Law School

New students, old teachers: Good morning! Another year to welcome! Every year in early September, I have to seriously think about what to say to my new classmates, and I hope that my speech will not be repeated, and I will not be able to cope with it. I will help the new students in their future study and life. In my opinion, the opening ceremony has many functions and purposes: for students, it is an important turning point in your life journey, and it is also a celebration for you to win the college entrance examination; for our law school, it is a welcome for new students. Meetings, college briefings, and teachers and students meet. Therefore, what I said to the 2007 freshmen is “Welcome to you, the new master of jurisprudence”, focusing on summarizing and refining the characteristics of the law of Wuhan University, that is, pioneering entrepreneurial spirit and the spirit of the first righteousness, eclectic spirit of openness. Considering that some students choose the legal profession aloud, I would like to say "Choose your true love, really love your choice" for the 2008 freshmen. It mainly emphasizes the important influence of interest on learning a profession and happiness in life. I hope that students will find you as soon as possible. Your true interest. What I said to the 2009 freshmen is "Why are you coming and what to take away?", mainly from the concept of learning, paying attention to mastering legal knowledge, practicing practical ability, and developing the spirit of the rule of law.

Today, considering that the vast majority of new students are just 18 years old this year, I want to use today's opening ceremony as a collective adult ceremony for you. Here, I will talk about my views under the heading "Becoming an adult? Becoming a mature person? Becoming an useful person? - ", and I hope to draw your thoughts and attention. The first part is about an adult's life from a relatively tightly closed secondary school to a more free and open university life, which is an important turning point in your life. First of all, you are faced with a transition from a natural person to a social person. During your 6 months, you have experienced physical weaning. You no longer rely on your mother's immunity to fight against the deteriorating natural environment. When you go to kindergarten and elementary school, you mainly rely on the care of your parents. Relying on the strict discipline of the teacher to learn; after you enter junior high school and high school, your life is still inseparable from the care of parents, and learning is also done under the guidance of the teacher. But today, when you wave your hand and say goodbye to your parents, you are experiencing a psychological "weaning period", you may be a little confused, a bit awkward, and some uncomfortable. This is very normal. But I hope that through today's adult rituals, you will shorten your psychological "weaning period" as soon as possible and complete the transition from natural people to social people as soon as possible. Legally speaking, at least 18 years of age is a fully capable person. Therefore, when you are a person with incapacity and a person with limited capacity, the guardianship and management of parents and teachers is their statutory duty and responsibility. When you are an adult, you are legally required to be responsible for your actions. The ‘behavior’ in the legal concept, in short, is the conscious physical and static state of the body. This requires you to establish self-reliance, self-awareness and independence. Specifically: First, we must have an economic sense of self-reliance. As you may know, college students in Western countries mostly borrow money from their own banks to complete their studies. Although China's social culture and habits are different, it is only natural for parents to support them before they become self-reliant in the economy. But what I want to say is that if you sleep peacefully on your parents remittance slips, keep a good "quiet" state, or even become a "old-fashioned", you will not meet the basic requirements of adults. Secondly, we must have a sense of autonomy in learning. It can be said that you mainly aim at "learning" in the middle school stage, because as long as you learn, you can successfully pass the college entrance examination and enter your ideal university. But after entering the university, your goal should be changed to "studying." Wuhan University just implemented the reformation of ‘credit system fee’  this year. Therefore, when you choose what course to study, how to learn, how to improve your learning ability, etc., you are solely responsible for your choice. The teacher just gives you some advice and guidance. It can be said that this is from "arranging marriage" to "free love" on the issue of learning. Therefore, you only have to "learn" to complete the university's learning tasks. Third, we must have a sense of independence in behavior. "Adult" means that you have an independent legal personality. Therefore, you have the right to do things that you could not do before, to engage in various activities independently, but you must be responsible for your actions. This is required by the principle of consistency of rights, obligations and responsibilities in the law. Everyone will continue to deepen their understanding of this principle in their future studies.

The second part, about growing students to our law school, is to grow into a "legal person" with a specific knowledge structure, practical ability, legal awareness and thinking habits. I thought that we must achieve the following two changes: First, the transition from the average person to the professional. In general, the knowledge you learned before high school was mainly a general basic knowledge. Modern universities provide students with different disciplines and expertise to purchase and train students into different fields and types of professionals. The so-called "doing professional people, doing professional things" means that the society has different requirements for professionals. Generally speaking, the quality model of a professional is mainly composed of loyalty, fairness, culture, morality, knowledge, and professionalism. Therefore, your mission at the university is not just to master and memorize your expertise. Second, the transition from a general professional to a legal person. As a special professional, I think the legal person must have 4 business qualities and multiple abilities. The so-called four kinds of business quality, that is, the legal person needs to have a strong "soft power" in addition to the "hard power" of legal expertise. If China's current primary and secondary education is still focused on the development of IQ (Intelligence Quotient), our university education began to pay attention to the development of students' EQ (Emotion Quotient). However, for legal education, it is far from enough to develop these two kinds of business. The legal person must also have MQ (Moral, Quortient) and CQ (Career Quotient). The so-called German business requires the legal person to have a higher moral quality than the average person and strictly abide by the legal professional ethics. The so-called job quotient requires the legal person to have a clear legal career development plan, not only to learn the law for employment, but to study the law for the profession and even the cause. The IQ, EQ, MQ and CQ of a legal person are different aspects of their overall quality. Sometimes, the key to determining a person's success is not IQ, but the overall strength of emotional intelligence, German business and business. The so-called multiple abilities are that legal persons should have logical thinking ability, research analysis and judgment ability, communication expression ability, cross-domain second or third expertise, foreign language ability, self-management ability, teamwork ability, frustration tolerance, interpersonal relationship ability, continuous execution and altruistic values, etc. The formation of these abilities requires long-term accumulation and multiple forms of exercise. The existing academic system, teaching content and teaching methods are difficult to enable students to achieve these abilities, and even the initial ability in these aspects can not be cultivated. However, according to my observation of the characteristics of the "post-90s" students, it can be summarized as follows: (1) The time spent on learning foreign languages is far greater than that of Chinese, and the level of foreign languages is improved, but the Chinese expression is generally weak, which is very unfavorable to the law. (2) The extra-curricular communication time is greater than interpersonal communication, and the ability to cooperate and communicate with others is generally not strong, which constitutes a natural obstacle to the necessary ability to form a legal person; (3) Great improvement in material living conditions It is more and more obvious contrast with the mental pressure brought by academics. This is easy to cause people to lose motivation and loss of learning interest. In severe cases, they may affect their mental health. In the third part, the purpose of ‘becoming useful person’ coming to law school is actually diverse: some study for employment, some for vocational, and some for career. I think these are all worthy of recognition. There is no difference between them. But the purpose is different, and its quality requirements, learning content and motivation are different. It can be said that the "legal craftsman" who masters the basic legal knowledge can deal with the employment problem, and only the legal person can really do a good job in the legal profession. The jurists all pursue the rule of law in China and the international society as their own career. As a first-class, internationally renowned Wuhan University Law School, we certainly hope that more students will learn for the rule of law in China and internationally.

I believe that in recent years, our law school has carried out some reforms and innovations in terms of school philosophy, teaching mode and learning methods. Mainly: First, the concept of running a school: from legal teaching to legal education. The cultivation of traditional legal talents in China can be called "legal teaching", mainly the study, research and interpretation of specific legal rules. The current judicial examination is also deeply affected by " The influence of "culturalism." It is undeniable that modern legal study must be based on legal provisions, but this is definitely not the whole of studying law, but the most basic requirement for studying law. Because the soul of the law is not only the interpretation of the article, but also the spiritual extension. However, in China's current legal education, legal students will focus on the preparation of judicial examinations, indifferent to social phenomena, and have no time to take care of them. As long as it is not the knowledge within the scope of the judicial examination, it is not only the basic subjects of the humanistic spirit, such as history, art, philosophy, and the legal students are not very concerned. Even the subjects that are not included in the judicial examination in the legal field are also weak. In this way, the law students lose their interest in historical and philosophical values, and turn their tools into ‘law craftsman’; the legal knowledge in the narrow sense is also limited by ‘domestic law’ and lacks an international outlook. But for a qualified legal person, only the "exam" can only solve the problem of personal employment, and can not adapt to the requirements of the legal profession and the rule of law. To be a promising legal person in the society, we must have a humanistic sentiment and care, and we must have an international macro vision. Therefore, we must carry out a true legal education, not a simple legal teaching. To achieve this goal, at the national level, legal education and judicial examinations must adapt to each other. Judicial examinations cannot be used as a baton for legal education, because judicial examinations have no way to measure the humanistic spirit and practical wisdom of candidates, or the law. People's emotional intelligence, German business and business are unable to pass the test. Therefore, the judicial examination should also take the initiative to consider how to promote China's legal education, attract social elites to the legal field, and make them become true legal persons. From our individual, everyone should have a longer career plan. Second, the teaching mode: from pursuing norms to encouraging innovation, the academic system, teaching content, class hours and credit requirements of undergraduates of law schools in China are basically the same. However, it is difficult to make a high school graduate a qualified or basically qualified legal person with or with the above four business functions and various abilities by a four-year or even six-year training .

Therefore, under the premise of adhering to the basic norms of legal education, our law school has continuously innovated, and has formed some characteristics and advantages in terms of curriculum arrangement and teaching content, so that students of Wuhan University Law School have basic legal knowledge, quality and ability. On the basis of it, it has its own characteristics and advantages, so as to adapt to the needs of social diversification. This requires our students to learn more actively and happier. Third, the learning method: from the teacher's initiative to the teacher-student interaction over the years, although everyone has noticed the reform of the legal teaching methods, many teachers have made fruitful attempts. However, the normalization of law school is still teacher-centered, with lectures as the main method, and students are often passively accepting knowledge. In this way, some of the basic skills necessary for a legal profession are not trained in the classroom, and the personality and creativity of the students are also obliterated. Therefore, to overcome the shortcomings of traditional teaching methods, the focus is to concentrate on mobilizing the enthusiasm and initiative of students, to improve students' participation in teaching activities; to increase the diversity of teaching and improve the adaptability of teaching activities to different students. Because teaching is a process in which teaching and learning are interrelated, mutually influential, and independent. In most cases, learning played a decisive role. Students can only improve their legal ability, experience the rule of law, and acquire legal knowledge only when they are independent and interactive. Therefore, all teaching methods must aim at teacher-student interaction, so that students in the law school's learning process become the guide, participator and advisor of teachers, actively acquire legal knowledge and other relevant knowledge, and form the necessary legal capacity to raising the process of becoming a correct career concept, developing innovative spirit and innovative ability. It can be seen that the students must grow into qualified legal persons who can adapt to the needs of the society in the next 4 or 6 years. It is not an easy task for you, teachers and law schools. In fact, it is very Big challenge. Let us "look up at the stars and down-to-earth", like the spirit of Xiaoting, summed up by Professor Gu Hailiang, the president of Wuhan University: to sublimate the requirements of learning into the need for growth, and help the students to complete the three major changes as soon as possible, that is, from natural people to social people, from the average person to the professional, from the general professional to the legal person. thank you all!
